LGBT理解増進法成立に対する抗議声明
誰でもひとりでも入れる労働組合プレカリアートユニオンは、LGBTQ+をはじめとした性的マイノリティーが職場や社会で直面する問題を、人権の問題と捉え、2015年から全国の労働組合に先駆けて、LGBTQ+の仲間の労働問題に取り組んできました。
これまで組合員の労働問題について企業と対峙する中で、差別禁止に関する法律が存在すれば、もっとスムーズに問題が解決した事例はたくさんあったであろうと認識しています。しかしそうした状況下でも、組合員一人ひとりが団結し、企業との話し合いや、時には裁判などにも取り組むことで、SOGIハラの問題をはじめとした、様々な労働問題を解決してきました。
そんななか、2023年2月3日の荒井首相補佐官(当時)によるLGBTQ+への差別発言を契機に盛り上がったLGBT法の成立機運には、そのきっかけは決して好ましいものではなかったにせよ、組合としても少なからぬ期待を寄せていました。
ところが、法案成立に向けた国会での議論は遅々として進まず、この間、いわゆるバックラッシュといえる、LGBTQ+、特にトランスジェンダー女性へのデマを含んだ差別言説は、SNSだけでなく政治家の間でさえも、「議論」の名の下に平然と語られるようになり、苛烈さを極めました。LGBT理解増進法が成立した今も、その苛烈さはやんでおらず、勢いを増すばかりです。
法案は、私たちが望んだLGBT差別禁止法をベースとしたものでもなく、2021年に与野党の議員が超党派で合意したLGBT理解増進法の条文からもさらに後退し、日本維新の会と国民民主党が提案した、「理解増進」とは名ばかりの、骨抜きを通り越し、差別的とも言える独自案を丸呑みした形で、成立してしまいました。
そもそも人権は、他人に理解など求める必要もなく、生まれながらに誰しもが持っている普遍的な権利です。「全ての国民が安心して生活することができる」などという前提を必要とするものでもありませんし、「国民」などという狭量なカテゴリーで語られるべきものでもありません。このような条文が取り入れられてしまったLGBT理解増進法は、もはや悪法以外の何物でもありません。このようなLGBT理解増進法の成立に抗議します。
しかしながら、プレカリアートユニオンは、これまでもこれからも、このような悪法を前にしても、労働者、とりわけLGBTQ+当事者をはじめとした不安定な立場にある仲間の労働条件の維持・改善や生活向上に向けて、ひるまず活動を続けていきます。

Statement of protest against the LGBT Understanding Promotion Law
The Executive Committee of Precariat Union and the union's LGBT Gender Equality Team have released the following protest statement upon the enactment of the LGBT Understanding Promotion Law.
As a union that anyone can join and can do so on individual basis, Precariat Union see issues that LGBTQ+ and all sexual minorities face at workplaces and in society as issues of human rights and have been working on labor issues that LGBTQ+ colleagues face since 2015, before any other union has done so.
In confronting corporations on labour issues that involve our members, we have become aware of the fact that many cases would have resolved more smoothly had there been a law that prohibits discrimination against sexual minorities. Nevertheless, even under such circumstances, our members stuck together, and through negotiations and in some cases through legal actions, our union has resolved various labour issues including cases on SOGI harassment.
In the midst of our campaigns, the then prime minister aide Masayoshi Arai made a discriminatory remark against LGBTQ+ on 3 February 2023 which triggered expectations for an enactment of an LGBT law. Although it started on the wrong footing, our union did have some high hopes.
However, not only did the debate at the Diet on the bill made slow progress, it backlashed. For example, discriminatory remarks including disinformation on LGBTQ+ and in particular on transgender women have become a norm in the name of "debate" and not only on social media but even amongst the politicians. It has not ceased even now that the LGBT Understanding Promotion Law is enacted and is accelerating.
The bill was not based on LGBT anti-discrimination that we advocate for. It even backtracked from the contents of LGBT Understanding Promotion Bill that cross-party politicians from ruling and opposition parties have agreed in 2021. And although the words "Understanding Promotion" were added, they merely stand in name. Japan Innovation Party and Democratic Party for the People who proposed these words went beyond watering down the bill by swiping out the original proposals based on their own discriminatory views.
To begin with, one’s human rights do not need to be understood by the others as everyone has this universal right from the day you are born.
Your right does not need any premises such as "all citizens can live with peace of mind," nor should it be discussed in narrow categories such as "citizens".
Once these clauses are incorporated in an LGBT legislation, it is nothing but a bad law. We, therefore, protest the enactment of LGBT Understanding Promotion Law.
Even in the face of this bad law, Precariat Union will continue to uphold and improve working conditions of our colleagues and in particular LGBTQ+ workers who are in precarious conditions as we have always done so.
